Another focal point of our employment law practice is counseling companies in restructurings and organizational changes and their implementation. We provide guidance for our clients’ business ideas from the start and work closely with them to develop solutions that take into account the legal framework as well as the required practical relevance and labor realities. This includes negotiations with employee representatives, e.g. regarding reconciliations of interests and social compensation plans, and with trade unions regarding collective agreements.
Beyond this, we provide expert counsel in all typical co-determination issues, such as the design of working hours models, compensation structures and IT solutions. This includes drafting and negotiating works and service agreements with works and staff councils as well as participation in arbitration committees.
We also assist with matters of external personnel deployment as well as the structuring of foreign assignments and secondments (inpats and expats). Furthermore, we advise in matters of data protection, employee inventions and compliance cases in close cooperation with the members of our corresponding teams.
Finally, we advise board members, managing directors and other executives on drafting contracts and avoiding personal liability and represent them in labor or civil court proceedings. Our expertise also includes the enforcement of and defense against liability claims against executive bodies.
